Something of value given in return for performance or promise of performance by another. In order for a separation agreement to be valid there must be consideration. Typically, in a separation agreement, the consideration is the mutual promises and agreements the spouses include in the agreement. In the absence of mutual promises the separation agreement may not be enforceable.
